AMERICAN SAILOR FACES CHARGES OF ATTEMPTED SPYING AND ENDEAVORING TO PEDDLE CLASSIFIED MATERIA

Petty Officer 2nd Class Bryan Minkyu Martin was taken into custody by NCIS and FBI agents on December 1st of last year for various alleged espionage related offenses, and earlier this month Navy officials disclosed the formal charges filed against him. The complete tally entails four counts of attempted spying, with an additional 11 counts of
improper use of secret information. It was purported in the warrant that the Fort Bragg stationed sailor received $3,500 from an undercover FBI operative as payment for turning over documents designated secret or top secret. Martin’s first encounter with the agent occurred on November 15 at a Hampton Inn close to Fort Bragg, wherein he informed his atingere that his duties then were connected to Afghanistan and he would eventually secure a position with the Defense Intelligence Agency, stressing how useful he could prove during the course of his career. The $500 payment to Martin at that meeting was followed by $1500 cash installments at two subsequent meetings for handing over more documents, at which point his arrest was effected.

The attempted espionage charges brought against Martin are extremely serious, since espionage is a capital crime pursuant to the Uniform Code of Military Justice (UCMJ). The UCMJ permits a death sentence when the offense impacts defense or counter defense against full-scale aggression, war tactics, communications intelligence, or crucial defense operations and policy. However, in practice imposition of a death sentence is very uncommon. As regards the current case, Navy authorities have not indicated if they will seek the death penalty. Martin is being held at the Norfolk, Virginia naval brig.
